Puddibear Website and Subscription Terms

1. Eligibility and Adult Authorization

The website signup and payment functions are intended for adults who can enter into a binding agreement. You represent that you have reached the age of majority where you live, are acting for yourself or with authority for your household, and are authorized to use the email address and payment method you provide. Children must not submit information or make payments through this website.

2. Website and Launch List

Adults may use the website to request launch updates, access the Puddibear community link, and purchase the subscription described in Section 4. Joining the launch list is optional and separate from purchasing the subscription. You may unsubscribe from marketing emails at any time. Payment receipts, service notices, refund notices and replies to transaction questions are transactional communications and may still be sent when needed.

The Puddibear device is sold separately. A subscription purchase is not a Kickstarter pledge or device purchase, and does not guarantee that a device will become available.

3. Subscription Purchase at a Glance

• Price: US$1, charged once.
• What you buy: An entitlement to three additional months of Puddibear+ software services. The service may involve ordinary voice conversations, asking questions about photos or identifying objects, voice drawing instructions, basic drawing/local canvas, AI image generation, turning photos or drawings into stories, playback of pre-made stories, AI-generated stories, bedtime stories, viewing and replaying saved creations, sharing creations with family, video or voice calls, alarms/settings/device status, location, parent access to children's creations, parent-created stories or Mini Apps, AI long-term memory, multiple child profiles and growth reports. The specific features included in this entitlement, their usage amounts and rules will be described in the service information displayed in the Puddibear product after launch.
• Start: The three-month service period starts when you activate an eligible device purchased through the official Puddibear Kickstarter campaign.
• Renewal: This US$1 purchase does not automatically renew and does not authorize a later charge.
• Refund: The US$1 is non-refundable, including after you purchase and activate an eligible Kickstarter device, except where applicable law requires otherwise.

An eligible Kickstarter device purchase may separately include a three-month subscription benefit under the final campaign terms. The US$1 purchase described here is for an additional three months of software services beginning after device activation. The subscription does not automatically convert to a paid subscription when the three-month period ends.

4. US$1 Software Service Purchase

4.1 One-time payment

You pay US$1 once in U.S. dollars through Stripe. This payment is not a device deposit, Kickstarter pledge or automatically renewing subscription. Puddibear does not add a website fee to the stated price. Your bank, card issuer or payment provider may separately charge currency conversion, cross-border or other fees outside Puddibear's control.

4.2 Service and access

The purchase entitles you to three additional months of software service after activation of an eligible device purchased through the official Puddibear Kickstarter campaign. The service may include categories of functionality listed in Section 3. The specific features included, usage amounts and rules will be described in the service information displayed in the Puddibear product after launch. The entitlement will be associated with the account or activation flow used for the eligible device.

Puddibear will not automatically charge you again when the three-month period ends. Any later subscription requires a separate purchase, with its price and renewal terms clearly disclosed before purchase.

4.3 Non-refundable payment

The US$1 purchase is non-refundable, including if you later purchase and activate an eligible Kickstarter device, except where applicable law requires a refund, cancellation or other remedy. This entitlement is additional to any subscription benefit included with the device purchase. The offer applies only to Puddibear devices purchased and activated through the official Puddibear Kickstarter campaign.

4.4 If you do not purchase or activate an eligible device

The additional three-month service entitlement is available only after activation of an eligible Kickstarter device. If you do not purchase and activate an eligible device, the service period will not begin. The US$1 remains non-refundable except where applicable law requires otherwise.

4.5 If the service cannot be provided or is materially delayed

If Puddibear cannot provide the purchased service or it is materially delayed, Puddibear will compensate you with an equivalent additional service period matching the period during which the service was unavailable or delayed. This does not limit any greater remedy required by applicable law.

4.6 Refunds required by law

Where applicable law requires a refund, Puddibear will process it to the original payment method within the period required by law and will not deduct merchant-side Stripe processing fees from the amount owed.

5. Duplicate or Incorrect Charges

If you believe the same purchase was charged more than once or charged incorrectly, contact us at [email protected] with your receipt or transaction reference. After verification, we will return the duplicate or incorrectly charged amount to the original payment method. A duplicate charge does not automatically add subscription time unless Puddibear confirms otherwise.

If Stripe confirms that a payment succeeded but the Puddibear page does not display it, do not pay again. Contact us with the minimum receipt information needed to locate the transaction.

6. Stripe and Transaction Records

Stripe processes payment information under its own terms and privacy policy. Puddibear does not receive or store your full card number, bank account number or card security code through this website. We receive transaction identifiers, payment email, amount, currency and payment status, and refund information when a refund is legally required.

You may dispute an unauthorized or incorrect charge and exercise any rights available under applicable law. Nothing in these Terms limits those rights.

7. Kickstarter and Future Product Terms

Kickstarter is a third-party platform. Kickstarter pledges or purchases are governed by Kickstarter's terms and the terms disclosed on the Puddibear campaign page. The subscription purchased here is separate from a Kickstarter pledge and device purchase. Terms for devices, applications, accounts, warranties, shipping or future subscriptions will be provided separately before the relevant transaction or data collection.

8. No Guarantee of Device Campaign or Delivery

Except for the express subscription commitments in these Terms and rights that cannot be excluded by law, joining the launch list or purchasing a subscription does not guarantee that a Kickstarter campaign will launch or succeed, that a device will be available in your country, or any particular device price, feature, color or delivery date. If a material change prevents Puddibear from providing the purchased subscription service, Section 4.5 and applicable law apply.

9. Acceptable Use and Intellectual Property

You must not use the website or payment flow unlawfully or fraudulently, submit another person's payment method without permission, bypass payment or security controls, interfere with the website or its providers, or use the website in a way that harms Puddibear or other visitors.

The Puddibear and Bubu names, logos, artwork, copy, software and other website content are owned by Puddibear or its licensors. These Terms give you a limited, personal, non-transferable right to use the website and purchased service as intended. They do not transfer ownership of any intellectual property.

10. Third-Party Services

The website may use or link to Stripe, Cloudflare, Mailchimp, Kickstarter, Meta/Facebook and other third-party services. Those services are governed by their own terms and policies. This section does not exclude responsibility that cannot lawfully be excluded.

11. Changes and Suspension

We may maintain, change or suspend website features for security, reliability, legal or business reasons. We will not use a website change to cancel a valid payment, subscription-access or refund obligation. We may update these Terms prospectively. Unless you agree to a later change or applicable law requires otherwise, the version accepted at checkout governs that purchase.

12. Disclaimers

To the maximum extent permitted by law, the website and pre-launch information are provided "as is" and "as available." We do not promise uninterrupted website access or error-free status displays. This does not disclaim the express subscription or service-delivery commitments in these Terms or any non-waivable consumer rights.

13. Limitation of Liability

To the maximum extent permitted by applicable law, Puddibear will not be liable for indirect, incidental, special, consequential or punitive damages arising from your use of the website or service. These Terms do not limit liability that cannot lawfully be excluded or limited, or any consumer rights you have under applicable law.

14. Governing Law and Disputes

Any dispute is governed by applicable law and will be handled by a body with jurisdiction under that law. These Terms do not exclude mandatory consumer rights available where you live. You may first contact us at [email protected] to try to resolve an issue.

15. General Terms

If a provision is unenforceable, it will be limited or removed only to the extent necessary, and the remaining provisions will continue. Failure to enforce a provision is not a waiver. These Terms, the Privacy Policy and the specific offer information shown in the product form the agreement for the website and subscription purchase, subject to mandatory consumer protections.
